 The þ Trans Equality Project  

 

The Trans Equality Project is a service from Press for Change which from the 7th January 2010 is providing:

A dedicated telephone and email equalities and human rights legal help and advice service for all trans people, for at least 1 day a week between the hours of 10am to 5.30pm.

The project will provide a service to ALL Trans people, those who work with them, and those who employ them or provide them with services.

Trans people include those people who:

  • cross dress or are
  • transvestite,
  • transsexual identified people who wish to have medical and surgical gender reassignment  and /or
  • transgender identified people who may or may not wish to use some gender reassignment services,
  • gender variant young people who wish to express their gender differently from that expected of someone of their birth sex,
  • people who identify as gender queer,
  • people who identify as androgyne or bigendered or agendered
  • drag kings and queens
  • people who have an intersex condition  and who also identify as trans (though note we are not experts on intersex conditions)  and 
  • anbody else who has a gender identity, or wishes to express their gender in a way which is different to that expected from someone of their birth sex.

The project has received partial funding from the Equality and Human Rights Commission for the period from December 2009 - the end of March 2011.

The remainder of the funding; £13,000.00 is to be raised during 2010 by Press for Change.

The phone line and email service will be available for enquiries from England, Wales or anywhere else where advice can be given, for example from foreign nationals applying for a UK Gender Recognition Certificate before coming to live in the UK.

 

The Project will work closely with the Scottish Transgender Alliance, to support the rights for trans people, and help where requested on Scottish cases.

We must congratulate Dr Lewis Turner, our current projects manager, who has taken a 3 year full time post as Hate Crimes officer at Wyre Borough Council. However this means trainer appointments cannot take place until the appointment of a new Projects Director is appointed.

PFC's TransEquality Project can advise if you have been on the receiving end of some action or incident which: 

CONTRAVENES YOUR HUMAN RIGHTS

1. Any Action, Practice or Incidents which Ignore or abuse your Human Rights AND

2. the action is done by a PUBLIC AUTHORITY e.g. a local authority, government department, public service such as policing, education or health service.

 

Under the Human Rights Axt 1998, every person in the UK has a right to:

FAIRNESS & RESPECT & EQUALITY & DIGNITY & AUTONOMY

   OR

UNLAWFULLY DISCRIMINATES AGAINST YOU

It is simple mathematics: 1+2+3=Unlawful Discrimination

IN order to make a claim for discrimination:

 

+1. You must receive Unequal or different treatment in

a) Employment or Vocational Training, or/ 

b) when accessing Goods or Services, or/

c) Facilities incl. Housing, or building use

 

+ 2. which has been to your detriment i.e. placed you at a disadvantage and

 

+ 3. which would not have happened if you had not been

a) Intending to undergo or

b) were undergoing or

c) had undergone  ... Gender Reassignment

 

= Unlawful Discrimination

 

Gender Reassignment means that a person is 'under medical supervision for gender dysphoria' which does NOT mean you have to be attending, or have attended a specialist Gender Identity Clinic.

Invoking Gender Reassignment as a protective ground (under s.82 of the Sex Discrimination Act, as amended, 1975)  can be proved by showing as little as the fact that you have spoken to your local family doctor and sought advise or counselling because you feel you are highly likely to be a transsexual person.


HOW TO KNOW YOU HAVE A CLAIM

2. PLEASE Help us Help you - Write a short diary of the events and incidents:

 

This really helps PFC to work out whether you might have a claim.

 

Our legal advisors are part time and many of the hours they put in on your behalf will be provided on a voluntary basis - so try and make our life a little easier. Type (preferred) orm write a diary of the events, and send it to us at transequality_at_pfc.org.uk (replace _at_ with @) along with your enquiry.

Include in your diary;

 

  • Dates of events
  • Times and circumstances of events
  • Details of People involved
  • Details of People who were witnesses
  • What actually happened including
    • the words said
    • the actions done
    • Any response you made at the time or later

Also, please provide details of:

  • who, if anyone, you have tried to address the matter with already including
  • how they responded
  • Include a basic outline of correspondence to date. We will ask for copies later if we require them, so please do not throw anything away.

Indicate if a meeting or disciplinary has been arranged, or court papers have been filed already.
